Consumer Financial Data and Non-Horizontal Mergers

BWC member Linda Jeng co-authors a new piece in the Fordham Journal of Corporate & Financial Law examining the competitive implications of non-horizontal mergers involving consumer financial data. The article explores how traditional antitrust frameworks may fall short when assessing mergers between firms that control large and complementary data sets, even when such deals promise consumer benefits.

Drawing on this analysis, Jeng and her co-authors, Jon Frost, Elisabeth Noble, and Chris Brummer, propose new metrics to better value data in merger reviews and offer tools for competition authorities to assess and mitigate potential anti-competitive effects in an increasingly data-driven economy.
